Hoorzitting IACHR inzake executie-traject in de zaak López Lone y otros vs. Honduras

Rechters_HondurasVandaag, op 10 februari 2017 vindt een besloten hoorzitting plaats bij het Inter-American Court of Human Rights inzake de naleving door Honduras van de belangrijke uitspraak López Lone y otros vs. Honduras uit oktober 2015 met betrekking tot een groepje ontslagen Hondurese rechters (zie http://www.corteidh.or.cr/index.php/audiencias-privadas).

De vertaalpoule van Rechters voor Rechters heeft een Engelse vertaling gemaakt van de officiële Spaanse samenvatting.

Rechters voor Rechters volgt deze zaak al sinds jaren. 1000px-Flag_of_Honduras_svgDe ontslagen rechters willen graag weer in hun functie worden hersteld, maar Honduras stelt zich op het standpunt dat dit niet mogelijk is nu er inmiddels andere gekwalificeerde rechters op hun posities zijn benoemd. De ontslagen rechters weigeren op hun beurt de financiële vergoeding, zodat er een patstelling is ontstaan.

Deze uitkomst van deze zaak in het executie-traject is niet alleen van belang voor de onafhankelijkheid van de rechterlijke macht in Honduras maar voor de hele regio.

Uitspraak in zaak Lopez Lone e.a. – Honduras

Op 5 oktober jl. heeft de Inter-American Court of Human Rights uitspraak gedaan in de zaak Lopez Lone e.a. tegen de Hondurese staat. Guillermo Lopez Lone, z1000px-Flag_of_Honduras_svgijn vrouw Tirza Flores Lanza en twee andere rechters waren door de Hondurese Corte Suprema ontslagen omdat zij hadden geprotesteerd tegen de staatsgreep in 2009, waarbij president Zelaya werd afgezet. De uitspraak heeft even op zich laten wachten: de mondelinge behandeling vond op 2 en 3 februari van dit jaar plaats. In een eerdere nieuwsbrief deed ik hiervan verslag. Maar het wachten is beloond. In zijn uitspraak stelt het Hof voorop dat de machtsovername in 2009 naar internationale maatstaven onrechtmatig was, en klagers met hun protesten het herstel van de democratie en de rechtsstaat hadden beoogd. Zij hadden niet alleen een hun toekomend recht uitgeoefend, maar zelfs voldaan aan hun morele plicht om op te komen voor de democratie, aldus het Hof. Hiermee zet het de toon voor de verdere uitspraak, waarin klagers op alle punten in het gelijk worden gesteld. Het Hof oordeelt dat de Hondurese staat de het legaliteitsbeginsel heeft geschonden, als ook klagers’ politieke rechten, vrijheid van meningsuiting en recht van vereniging en vergadering, en legt Honduras de verplichting op om de betrokkenen hun positie binnen de rechterlijke macht terug te geven.

Lopes Lone and others vs Honduras

IACHR_201502Guillermo Lopez Lone and Tirza Flores Lanza visited our country in November 2010. Tirza and Guillermo, appeal court judge and judge in the district court of San Pedro Sula, Honduras called for attention from Judges for Judges, a.o., for their then recent disciplinary dismissal. Together with two colleagues they both had taken part in a demonstration against the coup in 2009, which deposed of president Zelaya. The coup had been whitewashed by many at the time: Zelaya was supposed to have pushed an unconstitutional referendum, enabling him to extend his term of office. The Corte Suprema of Honduras supported those committing the coup. In the end the international community called the coup illegal.

Guillermo was not only a judge, but also the chairman of the Honduras’ Association of Judges Asociación de Jueces por la Democratia (AJD), which position he could no longer hold as a result of his dismissal.

Last 2nd and 3rd February the case ‘Lopez Lone and others vs Honduras’ finally came before the Inter-American Court of Human Rights in de Costa Rican capital of San José. This court is a part of the Organisation of American States OAS and is charged with the duty of applying and interpreting the American Human Rights Treaty. Although there are large differences, this court is the Latin-American counterpart of ‘our’ human rights court in Strasbourg. The most important difference is that a civilian cannot bring his case before the court in San José directly. The Inter-American Commission on Human Rights in Washington (DC) works as a filter. This commission is so ‘effective’, that only a handful of cases reaches the court every year.

The Commission presented the case to the court orally at the hearing. The court heard four experts on international human rights, called by the plaintiffs. These experts dwelled at length on the difference between declared enforceable rules of conduct on one hand, and the more open, ethical rules on the other. Also they referred to the question whether members of the bench are fully entitled to universally recognised human rights and liberties, or whether our profession forces us to put up with limitations of our rights. The plaintiffs referred to the experts’ arguments and claimed that the disciplinary proceedings, culminating in their dismissal, had violated the principles of fair trial, the principle of legality and their freedom of speech and assembly.

The government of Honduras rebutted that it does not suit a judge to take a political stand so explicitly. The disciplinary rules forbid to take part in political demonstrations and other behaviour that can harm the esteem of the office, and the plaintiffs just had to abide by the rules.\

The plaintiffs replied that it had been the Corta Suprema itself that had through the justice intranet called upon all to take part in a manifestation to support the coup. This was a rather explicit remark. In Honduras it is virtually impossible to keep one’s distance of political debate, just as it is in other Latin-American countries. The judges associations are politically coloured as well. The largest association in the country, the Asociación de Jueces y Magistrados de Honduras, is being reproached to rub to the government too closely, e.g. to do too little to protect its members during the recent ‘cleaning up’ of the judiciary in the ‘depuration’. This meant the dismissal or forced transfer of a great number of judges on account of actual or suspected –but unfounded- accusations of corruption. The ADJ wants to be independent, but by criticizing the government’s justice policy and in view of the government’s attacks on the independence of the judiciary, ADJ places itself in the opposition’s camp. 

Aftre the oral hearing, parties have been granted an adjournment until the end of March 2015 to present their written observations to the Corta Suprema and to answer the questions raised by the Corta during the hearing. The Corta will consider the case. De judgment is expected coming June.

It was not in any way distrust in the Inter-American Court that let Judges for Judges decide to have a judge travel to Costa Rica. All together some thirty observers had been invited by the ADJ, among which, apart from Latin-American judges, colleagues from Germany, Spain, Norway and Denmark. Of course, our presence there provided important support for our four affected Honduras’ colleagues, but the subject touches all of us. In The Netherlands as well, legislation is in process allowing for an extension of the scope of disciplinary measures against judges. It is most omportant that we should realize that this may be a relatively harmless instrument in the hands of a decent administration, but it may be used against us in times of political changes for the worse.

López Lone y otros contra Honduras

ccEn [noviembre de 2010], Guillermo López Lone y Tirza Flores Lanza visitaron nuestro país. Tirza y Guillermo, magistrada en la Audiencia y juez en el tribunal de San Pedro Sula, Honduras respectivamente, pidieron atención, entre otros a Jueces para Jueces, respecto de su despido disciplinario, entonces recién acontecido. Ambos habían participado, junto con otros dos colegas, en una manifestación contra el golpe de estado en 2009, durante el que el presidente Zelaya fue depuesto. El ‘golpe’ entonces fue excusado por muchos: Zelaya habría querido presionar por lograr un referéndum inconstitucional, que debiera de hacerle posible prorrogar su mandato. La Corte Suprema de Honduras también apoyó a los golpistas. Al fin y al cabo la toma del poder fue tildada de ilegal por la comunidad internacional.

Aparte de ser juez, Guillermo fue presidente de la asociación hondureña de jueces, Asociación de Jueces por la Democracia (AJD), una función que no pudo desempeñar más a causa de su despido.

ccIn november 2010 bezochten Guillermo Lopez Lone en Tirza Flores Lanza ons land. Tirza en Guillermo, respectievelijk raadsheer in het hof en rechter in de rechtbank van San Pedro Sula, Honduras, vroegen bij onder andere Rechters voor Rechters aandacht voor hun toen recente disciplinair ontslag. Beiden hadden, samen met twee andere collega’s, deelgenomen aan een demonstratie tegen de staatsgreep in 2 009, waarbij president Zelaya werd afgezet. De ‘coup’ werd destijds door velen vergoelijkt: Zelaya zou een ongrondwettig referendum hebben willen doordrukken dat het hem mogelijk moest maken zijn ambtstermijn te verlengen. Ook de Corte Suprema van Honduras steunde de coupplegers. Uiteindelijk werd de machtsovername door de internationale gemeenschap als onwettig aangemerkt.

Naast rechter was Guillermo voorzitter van de Hondurese rechtersvereniging Asociación de Jueces por la Democracia (AJD), een functie die hij door zijn ontslag niet langer kon vervullen.

Rechters voor Rechters woont procedure Hondurese collega’s bij in Costa Rica

Op 2 en 3 februari heeft collega Katrien Witteman (rechtbank Noord-Holland) in San José, Costa Rica namens Rechters voor Rechters de zitting bijgewoond van het Inter-Amerikaans Hof voor de Rechten van de Mens (CIDH). Het gaat om Adán Guillermo López Lone, Luis Alonso Chévez de la Rocha, Ramón Enrique Barrios Maldonado en Tirza del Carmen Flores Lanza.

Rechters voor Rechters heeft sinds het bezoek van de twee – in de nasleep van de staatsgreep in 2009 – ontslagen Hondurese rechters Tirza del Carmen Flores Lanza en Adan Guillermo Lopez Lone aan Nederland op 2 november 2010 geregeld contact met hen onderhouden. Dit keer niet ‘De hobby van ….’, maar ‘Het goede werk van Katrien Witteman: ‘A woman with a mission’. Katrien Witteman, (nu nog) rechter-commissaris bij de afdeling handel & insolventies, heeft als afgevaardigde van ‘Rechters voor Rechters’, een congres in Honduras bijgewoond. Een hele interessante reis voor een stichting die zeer goed werk verricht.

Slotverklaring conferentie Honduras inzake de verdediging van de rechterlijke onafhankelijkheid in Midden-Amerika

Namens de Stichting Rechters voor Rechters bezocht Katrien Witteman een congres over de onafhankelijkheid van de rechterlijke macht in Midden-Amerika dat op 31 oktober en 1 november 2013 werd gehouden in Tegucigalpa (Honduras). Het congres was georganiseerd door de Neue Deutsche Richtervereinigung en de Hondurese Asociacion de Jueces por la Democracia. Hieronder treft u de slotverklaring aan.

La CIJ condena asesinato de la Jueza Mireya Mendoza Peña en Honduras

La CIJ condenó el asesinato de la jueza del Tribunal de Sentencia de la ciudad de El Progreso y Pro-Secretaria de la Junta de la Directiva Nacional de la Asociación de Jueces por la Democracia de Honduras.

La Jueza Mireya Mendoza fue ultimada por los disparos hechos desde una motocicleta mientras conducía su vehículo en la mañana del 23 de Julio en la ciudad de El Progreso, Departamento del Yoro, Honduras.

Ramón Cadena, Director de la CIJ para Centroamérica señaló: “Condenamos en los más enérgicos términos el asesinato de la Jueza Mendoza Peña”.
