RR aanwezig bij Medel

Op 13-16 februari vond in Braga (Portugal) de Medelconferentie plaats. Medel staat voor Magistrats européens pour la démocratie et la liberté [www]. Rechters voor Rechters heeft daar de status van observer. Esther de Rooij heeft Rechters voor Rechters vertegenwoordigd.

Gesproken is o.a over de situatie in Turkije. Onze Turkse collega’s zijn verontrust, boos en zeer geëmotioneerd over wat er gaande is in Turkije. Na het gestarte onderzoek in december 2013 naar corruptie bij de regering van Erdogan is de situatie voor onze collega’s in snel tempo ernstig geworden. Zij zijn met stomheid geslagen dat zich deze ontwikkeling kon voordoen. Vele politiemannen, officieren en rechters zijn verplaatst omdat deze de regering onwelgevallige beslissingen hadden genomen. Ontslag Bulgaarse rechter Miroslava Todorova disproportioneel

Gister heeft het panel van vijf leden van de Supreme Administrative Council (SAC) te Sofia, Bulgarije, uitspraak gedaan in hoogste instantie in de ontslagzaak van collegarechter Miroslava Todorova. Het ontslag is van de baan! De Supreme Judicial Council (SJC) had Todorova op 12 juli 2012 ontslagen als rechter in het Sofia City Court vanwege het (grote) tijdsverloop dat met de uitwerking van beslissingen op schrift was gemoeid. Alle ingewijden waren het er over eens dat dit ontslag een door de politiek ingegeven beslissing was. In eerste instantie had het panel van drie leden van de SAC de ontslagbeslissing in stand gelaten. De SAC heeft gister, in tweede instantie, besloten dat de ontslagbeslissing disproportioneel is. De zaak wordt terugverwezen naar de SJC voor het nemen van een nieuwe beslissing. Rechters voor Rechters was als trial observer aanwezig bij de (hoger beroeps)zitting van de SAC op 16 mei jl. Trial observation dismissal Bulgarian Judge Todorova

On May 16 2013 Judges for Judges – in cooperation with the International Commission of Jurists (ICJ) and Magistrats européens pour la démocratie et les libertés (MEDEL) – attended the hearing before the Supreme Administrative Council (SAC) in Sofia in the dismissal case of Judge Miroslava Todorova. Todorova served many years as an outstanding criminal judge in the Sofia City Court and as the leader of the Bulgarian Judges’ Association. In that last capacity, she was critical of interferences by the executive branch of government in the work of the judiciary, and of the consistently poor management of Bulgaria’s judiciary.

 

Following to accusations of influence and bias in organised crime cases by the then Minister for Interior Affairs, Todorova filed a court case for slander against him (which, after acquittal of the Minister, is now pending at the appeal stage). She has subsequently been dismissed from the judiciary by the SJC on 12 July 2012. The official ground for her dismissal was the long delays in issuing the reasoning in a number of court cases. Judges for Judges and ICJ observe appeal against dismissal of a judge in Bulgaria | CIJL-ICJ

On 16 May, the International Commission of Jurists (ICJ) and Rechters voor Rechters (Judges for Judges) observed an appeal hearing at the Supreme Administrative Court (SAC) in a case against the dismissal of Miroslava Todorova, a Judge who had been serving on the Sofia City Court.

Judge Todorova is known for critical commentary on the problems in the judiciary in Bulgaria. In this hearing, the Prosecutor’s Office supported Judge Todorova’s appeal against her dismissal, but the Court has not yet issued its decision.

The ICJ previously raised concerns over Judge Todorova’s dismissal from her position of judge and as Chair of the Bulgarian Judges Association, in July 2012.
