Gister heeft het panel van vijf leden van de Supreme Administrative Council (SAC) te Sofia, Bulgarije, uitspraak gedaan in hoogste instantie in de ontslagzaak van collegarechter Miroslava Todorova. Het ontslag is van de baan! De Supreme Judicial Council (SJC) had Todorova op 12 juli 2012 ontslagen als rechter in het Sofia City Court vanwege het (grote) tijdsverloop dat met de uitwerking van beslissingen op schrift was gemoeid. Alle ingewijden waren het er over eens dat dit ontslag een door de politiek ingegeven beslissing was. In eerste instantie had het panel van drie leden van de SAC de ontslagbeslissing in stand gelaten. De SAC heeft gister, in tweede instantie, besloten dat de ontslagbeslissing disproportioneel is. De zaak wordt terugverwezen naar de SJC voor het nemen van een nieuwe beslissing. Rechters voor Rechters was als trial observer aanwezig bij de (hoger beroeps)zitting van de SAC op 16 mei jl.

Last-Instance Court Revokes Dismissal of Ex-Chief of Bulgarian Judges Association

Sofia – A five-judge panel of the Supreme Administrative Court (SAC) revoked the dismissal of Judge Miroslava Todorova.
The judge and former chair of the Bulgarian Judges Association was fired in 2012 by the previous composition of the Supreme Judicial Council (SJC) because she was late writing he reasoning behind three of her judgments. Confirmed by a lower instance panel of SAC, Todorova’s dismissal was largely seen as politically motivated. It followed the judge’s slander suit against former Interior Minister Tsvetan Tsvetanov over his repeated attacks against her.
While it confirmed that Todorova broke the rules by delaying the reasonings, the five-judge panel of SAC found that the Supreme Judicial Council violated the law and the principle of proportionality in determining Todorova’s punishment.
Todorova’s case is now going back to the SJC which will have to reconsider the punishment.
